5. Client Responsibilities

Clients are responsible for:

Delays caused by client inaction may result in project timeline extensions.

6. Intellectual Property

Client Work: Upon full payment, clients receive ownership of the final deliverables as specified in the project agreement.

MakeWorking IP: We retain rights to our proprietary tools, frameworks, and methodologies used in project delivery.

Portfolio Rights: We reserve the right to showcase completed projects in our portfolio unless otherwise agreed.

7. Warranties and Disclaimers

We warrant that our services will be performed with reasonable skill and care. However:

  • We do not guarantee specific business results or outcomes
  • Third-party services and platforms are beyond our control
  • Website performance depends on hosting and external factors

Our services are provided "as is" without warranties beyond those explicitly stated.

8. Limitation of Liability

To the maximum extent permitted by law, MakeWorking shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages exceeding the amount paid for the specific service

9. Confidentiality

We respect the confidentiality of client information and will not disclose proprietary information without permission, except as required by law.

10. Termination

Either party may terminate a project agreement:

  • By mutual written agreement
  • For material breach of terms (with notice period)
  • If payment terms are not met

Upon termination, client pays for work completed to date.

11. Support and Maintenance

Post-launch support terms vary by project:

  • Bug fixes during warranty period (typically 30 days)
  • Ongoing maintenance available via separate agreement
  • Emergency support may incur additional fees

12. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective upon posting to this page. Continued use of our services constitutes acceptance of modified terms.

13. Governing Law

These terms are governed by the laws of Pakistan. Any disputes will be resolved through negotiation or, if necessary, in the courts of Pakistan.
